Art Commission Terms of Service

By purchasing a commission from me, you agree to the following terms:

General

  • I reserve the right to decline any commission request for any reason.
  • Commissioned artwork is for personal use only unless commercial rights are discussed and purchased separately.
  • I retain the copyright to all artwork unless otherwise agreed in writing.
  • Prices are subject to change at any time during the planning process before payment, but confirmed commissions will keep the agreed-upon price.

Payment

  • 50% payment must be made upfront before I begin working on your commission.
  • I accept payment through PayPal or Venmo.
  • Work will not begin until payment is received.
  • All prices are listed in USD unless otherwise stated.

Refund Policy

  • Full refunds are available only before work has started.
  • Partial refunds may be issued depending on the stage of completion.
  • No refunds will be given after the final artwork has been delivered.

Process & Timeline

  • Estimated turnaround time is approximately 1-2 weeks, but is subject to longer if the project is exceedingly complex.
  • Delays may occur due to illness, emergencies, workload, or life circumstances. I will communicate any major delays.
  • Clients are responsible for providing clear references and descriptions before work begins.

Revisions

  • 1 to 3 minor revisions are included during the sketch phase.
  • Major changes after approval of the sketch may incur additional fees.
  • I will not redraw an entire piece after substantial progress has been made.

Communication

  • Please respond to updates or questions within a reasonable timeframe.
  • If there is no response from the client for 30 days, the commission may be considered abandoned without refund.

Shipping Policy (For Physical Artwork)

  • Physical items will be shipped to the address provided by the client. Please ensure your shipping information is correct before purchase.
  • I am not responsible for packages lost due to incorrect addresses provided by the client.
  • Shipping costs are not included in commission prices unless otherwise stated.
  • Delivery times may vary depending on location, postal service delays, customs processing, weather, or other circumstances outside my control.
  • Once a package has been shipped, I am not responsible for delays, damage, or loss caused by the shipping carrier.
  • Tracking information will be provided when available.
  • International clients are responsible for any customs fees, import taxes, or VAT required by their country.
  • Refunds or replacements for lost or damaged packages will be handled on a case-by-case basis.
  • Original artwork may contain slight imperfections due to the handmade nature of the piece.
  • I package artwork carefully to help prevent damage during transit.

Usage Rights

Client Rights

You May:

  • Use the artwork for personal use
  • Post the artwork online with credit
  • Print the artwork for personal display

You May Not:

  • Use the artwork for commercial purposes without explicit permission
  • Redistribute or sell the artwork without the artist's consent
  • Mint or sell the artwork as NFTs

Artist Rights

I May:

  • Post commissioned artwork on my social media, portfolio, or commission examples
  • Use cropped or watermarked versions for self-promotion unless otherwise agreed

Commercial Use

Commercial rights are not included in standard commission pricing.

Commercial usage includes:

  • Merchandise
  • Branding/logos
  • Advertising
  • Streaming assets
  • Book covers
  • Monetized content

Clients may not reproduce, distribute, sell, profit from, or commercially use commissioned artwork without written permission and the purchase of commercial rights.
Commercial pricing varies depending on the intended use, audience size, distribution, and exclusivity requested.

Unless otherwise agreed:

  • I retain full copyright ownership of the artwork
  • The client receives a non-exclusive license for the agreed commercial purpose only
  • The artwork may not be sublicensed, resold, or transferred to third parties

Credit to me as the artist is appreciated and may be required depending on the project.

Content Restrictions

I will NOT draw:

  • Hate speech or discriminatory content
  • Extreme gore
  • Explicit illegal content
  • Content involving minors in sexual or suggestive situations

I may draw:

  • Original character designs
  • Fanart
  • Mild gore
  • Suggestive content

Chargebacks & Fraud

Unauthorized chargebacks or payment disputes after artwork delivery will result in legal action, blacklisting from future commissions, and public warning to other artists if necessary.

Agreement

By commissioning me, you acknowledge that you have read and agreed to these terms.
